Supreme Court orders release of jailed attorney

Four weeks after being jailed on criminal contempt charges, Douglas County attorney Carl E. Smith walked free from Ozark County Jail last week. Smith was released Oct. 23, 15 minutes after the Missouri Supreme Court ordered his release. The high court is still considering his request for post-conviction relief. Bruce Galloway, Smith's attorney, said he filed a motion seeking his client's release after it became apparent the court will not decide his writ for habeas corpus for weeks.

Attorney jailed on criminal contempt charges

The Missouri Association of Criminal Defense Attorneys and the American Civil Liberties Union have jumped to the defense of Douglas County attorney Carl Smith (pictured), who was hit with a 120-day sentence on criminal contempt charges for critical statements he wrote about an associate circuit judge, R. Craig Carter, and prosecutors in an appellate brief for a client.

Smith has been sitting in jail since Sept. 28.
