Standard could be reviewed

An appeals court has asked the Missouri Supreme Court to hear a case concerning the standard plaintiffs have to prove in whistleblower actions. The Missouri Court of Appeals Eastern District determined that Daniel Margiotta had presented enough evidence to survive summary judgment in his suit against Christian Hospital Northeast Northwest. “In this case, the record contains evidence that would support a finding of exclusive causation as well as evidence that would support a finding that respondents had a valid, non-pretextual reason to fire the appellant,” wrote Chief Judge Nannette Baker, Missouri Court of Appeals Eastern District

Suit survives for officer who says she had to quit

A police officer's discrimination lawsuit against a St. Louis suburb will proceed after a ruling from the Missouri Supreme Court. St. Louis County Judge James Hartenbach granted the city of Maplewood's motion for summary judgment on the grounds that officer Ellen Wallingsford's suit was filed too late. But the Supreme Court found that the judge had failed to comply with summary judgment procedures by not allowing Wallingsford to present additional evidence that discriminatory actions were taken during the filing period.

Bill Colby, right-to-life lawyer, begins new career

When it comes to end-of-life questions, we as a society aren't doing enough talking, said William Colby, a nationally recognized expert and attorney on right-to-life issues. "As a society we have to get better about talking about what we want when we're ill," he said. "We're afraid to talk about the one natural occurrence that happens to us all. Even if you have talked to your family a lot about it, the decision-making is profoundly hard, and it's almost too much of a burden for someone to make a decision without written guidance." Colby, 54, joined Truman Medical Center in Kansas City as its general counsel last week. He is well-known for representing the family of Nancy Cruzan in its right-to-die case before the U.S. Supreme Court.
