Interview not prejudicial to defendants, court says

The Missouri Supreme Court upheld an $825,000 medical malpractice verdict, finding that a videotaped news interview with the plaintiff did not warrant a new trial.

Last November the Missouri Court of Appeals in St. Louis threw out the verdict and ordered a new trial.

The plaintiffs' lawyer, Derek H. Potts, of The Potts Law Firm in Kansas City, said the Eastern District court second-guessed the trial judge's decisions.

The Supreme Court adhered to the abuse of discretion standard of review, he said.
