Federal court rules Vaccine Act suit time-barred

The statute of limitations under the Vaccine Act was triggered when the plaintiff first exhibited symptoms or manifestations of the claimed injury, the en banc Federal Circuit has ruled in finding a suit time-barred. A doctor received three Hepatitis-B vaccinations in 1996 and 1997. In 2005, she filed a claim under the Vaccine Act, seeking compensation for her multiple sclerosis, which she alleged was caused by the vaccine.
