Boeing doesn’t owe commission

Kuwaiti company claimed credit for helicopter deal

A Kuwaiti wholesaler is not entitled to a $10 million commission on the sale of 16 Apache helicopters to the Kuwaiti government, the 8th U.S. Circuit Court of Appeals said. The court found that the contract between a defense contractor and the wholesaler expired more than two years before the sale took place. Al-Khaldiya Electronics and Electrical Equipment Co. and McDonnell Douglas International Sales Corp., a subsidiary of The Boeing Co., agreed Al-Khaldiya would solicit and promote sales or leases of McDonnell Douglas products.
